Trial for man accused in Windermere rapes begins

ORANGE COUNTY, Fla. — A jury was seated and the trial of a Windermere man accused of drugging and raping unconscious women began Monday.

Orange County investigators said Darryl Patterson raped the women in his home, while they were unconscious, in 2009.

He was arrested in 2016 after an ex-girlfriend turned video of some alleged assaults over to investigators years earlier.

During proceedings, the jury watched a video of Darryl Patterson and the alleged victim having sex.

On the recording, the victim begs Patterson multiple times to wait until the next day. But the victim didn't remember the incident.

"She saw a bulletin that was put out by the Windermere Police Department. And she recognized herself on it," said Deborah Barra, assistant state attorney.

The victim, who took the stand, said she still can't remember that night.

"As I was walking to the ladies room, I was feeling a little funny. And I went to ladies room and came out and I was feeling a little tingly," she said.

The defense acknowledges that Patterson is the one on the tape and chose to focus on whether the sex was consensual.

"I think during this trial you'll see that [the alleged victim] tries to downplay her actions on that night," said Sasha Weitzner, defense attorney.

Patterson turned down a plea deal offer last month.

He is charged with sexual battery and attempted sexual battery.
