WINTER SPRINGS, Fla. — A Winter Springs man said he was supposed to be dealing with construction noise at his apartment for two weeks, but it’s now been going on for two months.
Marcus Peeler said he’s had workers cutting holes in his walls from the outside while he and his family were inside his apartment at Laurel Oaks Apartments.
Peeler described it as a nightmare scenario, and he’s trying to get out of his lease; so far, without luck.
“It’s constant noise,” Peeler said. “There’s holes everywhere. My kids literally asked me, they were like, ‘Dad, why are we living in a broken home?’”
Peeler said when he initially asked to be moved, he was told by the complex that no other units were available.
Then he posted videos of the renovations on TikTok, and he said the complex asked him to sign a nondisclosure agreement and take the videos down, and offered him an apartment in a different unit.

But Peeler said when they looked at the other unit, the smell inside affected his wife’s breathing.
Instead, Peeler said he wants the complex to release him from their lease and help them move.
When Channel 9 asked a worker at the complex’s front office about the case, they offered no comment.
An attorney who deals with tenant issues told Channel 9 the complex has a right to take care of the property, and by offering an alternative, doesn’t necessarily have an obligation to end the lease. But the attorney said the damage inside should be repaired.
The attorney said people in a situation like this should send what’s called a seven-day “notice to cure,” basically demanding repairs be made. If they’re not made in a week, they should be able to get out of the lease.
