Man arrested after fatally shooting Burger King worker in restaurant’s parking lot following fight, deputies say

ORANGE COUNTY, Fla. — Deputies said they arrested a man in connection with a deadly shooting outside an Orlando-area Burger King on Saturday night.

Investigators said Kelvis Rodriguez-Tormes, 37, was booked into jail early Sunday on charges of first-degree murder in the death of Desmond Joshua, 22, who just started working at the restaurant.

The shooting happened around 7:30 p.m. in the parking lot of the Burger King at East Colonial Drive and Goldenrod Road.

According to a report, Joshua was working the drive-thru at the Burger King when a woman began to yell and threaten him. A witness said the woman threatened to bring her “man” into the restaurant.

Someone at the restaurant refunded the woman and told her to leave.

A witness said the woman parked her car and remained in the parking lot for approximately five minutes. She then left for two minutes and returned with a white work truck, which was being driven by Rodriguez-Tormes.

The report said Rodriguez-Tormes demanded to fight Joshua.

Joshua and Rodriguez-Tormes got into a fight and Rodriguez-Tormes placed Joshua into a headlock and began to choke him, according to a report.

A witness told deputies that they were able to break up the fight.

The witness said after the fight, they saw Rodriguez-Tormes arm himself with a handgun, enter the driver’s seat of the white truck, lower the window and overheard him say “You got two seconds before I shoot you.”

Shortly after, the witness told deputies they heard gunshots and saw Joshua fall to the ground in the parking lot.

Deputies said the driver fled the scene.

Joshua was rushed to a hospital but died from his injuries.

Deputies did not give a motive for the shooting or say whether the men knew one another, but they said the investigation is ongoing.
