Investigation clears assistant state attorney who wrote "crack hoes" Facebook post

ORANGE COUNTY, Fla. — Channel 9 has obtained the results of an internal investigation into an assistant state attorney who made controversial remarks on his Facebook page in May.

In a letter to State Attorney Jeff Ashton, Chief Assistant State Attorney Linda Drane Burdick wrote that there is no evidence to suggest Kenneth Lewis prosecuted cases based on bias or prejudice.

Records show Drane Burdick reviewed 55 cases Lewis prosecuted in the past two and a half years.

"The results of the investigation are not surprising," said WFTV legal analyst Bill Sheaffer. "Ken Lewis was a very good prosecutor."

Lewis issued a statement to Eyewitness News saying, "The review confirmed what I knew all along and that is I wasn't biased."

Sheaffer said he doesn't expect his controversial Facebook post to hurt him in front of future juries.

"Because during the jury the selection process you can bet he's going to ask potential jurors whether they are aware of this incident," said Sheaffer.

Sources indicate Lewis will likely be able to go back to prosecuting major felony and homicide cases.
