Here are the bills the Florida Legislative Black Caucus is proposing for criminal justice reform

TALLAHASSEE, Fla. — The Florida Legislative Black Caucus is proposing more than a dozen bills targeting police reform during the latest legislative session.

Here’s a breakdown of 14 of the bills the group is proposing:

Establishing uniform law enforcement agency standards

Requiring the Department of Law Enforcement to adopt rules setting out minimum requirements for policies of law enforcement agencies; specifying areas that must be addressed by such policies; requiring the department to create a model procedures document for law enforcement agencies; specifying requirements for the model procedures document, etc. (SB 942 & HB 647 by Senator Audrey Gibson and Representative Tracie Davis.)

Reforming qualified immunity

Providing for a civil action against an officer, employee or agent acting under color of law of this state or its political subdivisions for the deprivation of rights secured under the United States and State Constitutions; specifying circumstances under which an officer, employee or agent is immune from liability; providing for the award of attorney fees and costs to a prevailing plaintiff; specifying applicability of laws governing the defense of civil actions, and the payment of judgments or settlements, against specified officers, employees and agents, etc. (SB 670 & HB 261 by Senator Shevrin Jones and Representative Michele Rayner.)

Limiting the acquisition of certain military equipment

Prohibiting law enforcement agencies from acquiring certain surplus military equipment; prohibiting the use of certain munitions and tear gas, etc. (SB 878 & HB 187 Senator Perry E. Thurston, Jr. and Representative Travaris McCurdy/Representative Angie Nixon.)

Collecting information regarding use of force incidents

Requiring each law enforcement agency to collect and report to the Department of Law Enforcement specified information on a monthly basis, including number of traffic stops, race and ethnicity of the law enforcement officer and the person stopped, whether arrested, etc. (SB 454 & HB 577 by Senator Randolph Bracy & Representative Anika Omphroy.)

Mandating universal accreditation for law enforcement agencies

Requires that formerly voluntary accreditation program be mandatory; requires FDLE to establish review process to assist agencies that fail to obtain or maintain accreditation. (HB 299 by Representative Felicia Robinson.)

Establishing a minimum age of arrest

Would ban arrest for children under 10 years old. (HB 303 by Patricia Williams.)

Reforming juvenile justice changes

Creating the “Kaia Rolle Act”; prohibiting a child younger than a certain age from being adjudicated delinquent, arrested or charged with a violation of law or a delinquent act; authorizing children of at least a specified age, rather than of any age, to be taken into custody under certain circumstances; requiring that children who are taken into custody pursuant to certain circuit court orders be treated in a specified manner and be detained only pursuant to specified findings, etc.

Reforming of police bill of rights

Repeals provisions relating to law enforcement officers’ & correctional officers’ rights; repeals provisions relating to processing & reviewing complaints, inactive investigations and officer statements. (HB 6057 by Omari Hardy.)

Repealing Stand Your Ground

Removes provisions allowing use or threatened use of deadly force to prevent imminent death or great bodily harm or to prevent imminent commission of forcible felony. (HB 6035 by Yvonne Hinson.)

Raising juror compensation

Raises the rate of compensation for jurors and prohibits the use of peremptory challenges to strike prospective jurors in criminal jury trials. (SB 442 & HB 739 filed by Senator Randolph Bracy and Representative Kristen Arrington (D - Osceola).)

Restricting the use of no-knock search warrants

Establishing uniform standards for body and dashboard cameras

SB 452 & HB 569 by Senator Randolph Bracy and Representative Kevin Chambliss (D-Miami).

Creating police misconduct registry

Creates a police misconduct registry that tracks the history of law enforcement officers.

Reforming compensation for excessive force victims

Reforms compensation for victims of excessive use of force by law enforcement officers.
