He was declared dead on the scene before Investigators determined he’d been shot twice.
According to police, Sherry Fitzpatrick claimed at the time that she’d slept in a separate, detached residence because of an argument the couple had the previous night.
Police say there was no gun found near Timothy but noted that there was a .45 caliber handgun in a nightstand in the bedroom, and two apparent bullet holes in the bedroom wall.

Almost two weeks later, during an interview, police say Fitzpatrick changed her story about what happened to her husband.
Investigators say they ultimately found cause to charge Fitzpatrick with murder and gave her an opportunity to turn herself in Wednesday, but she never made contact.
They tracked Fitzpatrick down to a home in Volusia County where deputies found her unconscious from an apparent suicide attempt.
