Jury to hear prior testimony from wife of man accused of her attempted murder

BREVARD COUNTY, Fla. — A Brevard County jury will hear testimony from the victim in an attempted murder case after she left the area on a vacation.
 
Gavin Chung is accused of shooting at his wife in the parking lot of Holmes Regional Medical Center last fall.
 
Prosecutors weren't able to find his wife after her daughter said she went on vacation despite a subpoena from the court. Sharonda Chung, the victim's daughter, said her mother doesn't plan on returning to Brevard County anytime soon.
 
"She said she needed to get away. She's stressed out and she needed to get away for a little bit," Sharonda Chung said.
 
Prosecutors said the victim was sitting in her car outside of the hospital when the defendant shot at her, narrowly missing her head. She was able to drive away and flag down an ambulance for help.
 
In a recent affidavit, the victim said she did not want to participate in the prosecution of her husband.
 
A judge ruled that the jury will hear from her despite her absence. She testified during a bond hearing for the defendant in January.
 
Opening statements could begin as early as Wednesday morning.
 
If prosecutors locate the victim during the trial, she will be taken into custody as a material witness.
