Parents file lawsuit against state, school districts after 'FSA opt-out' children held back

ORLANDO, Fla. — A group of parents have filed a lawsuit against the state and several school districts, demanding their children move on to the next grade level after students were held back when they opted out of taking the FSA test.

The parents are seeking an emergency order, hoping a judge will allow their children to move on to the next grade.

Channel 9 spoke with a parent in Seminole County who said she was told if her child opted out, she would be held back.

Students who received report cards with passing grades, some of whom were honor roll students, won’t be allowed to move to the fourth grade.
The lead plaintiff is from Orange County, and she and other parents said students without reading problems are being kept in the third grade because they opted out of standardized testing.
They said the rules are confusing and school districts are not interpreting them the same.
Parents said it’s not fair because other students who take the test and do poorly are allowed to move on to the fourth grade.
